Syracuse (WSYR-TV) – A man who authorities say participated in the Boston Marathon bombing that killed three people and injured more than 175 will be charged with using a weapon of mass destruction.

Multiple news agencies reported that 19-year-old Dzhokhar Tsarnaev was formally charged while still in his hospital bed.

In addition, CNN reported that he was charged with one count of malicious destruction of property by means of an explosive device resulting in death, according to a statement from the Justice Department.

The charge of using a weapon of mass destruction resulting in death could lead to the death penalty in the case of a conviction.

Tsarnaev and his brother, 26-year-old Tamerlan Tsarnaev, were both suspects in the bombing in Boston.

The older man was killed in a gunfight with police last week.

Dzhokhar was found badly wounded and holed up in a boat on Friday evening.

The White House indicated on Monday that the Russian national would not be charged as an enemy combatant.

The incident has largely been considered an act of terrorism.
