State Police make arrest in dog abuse case that humane society said may be the worst it’s ever seen

State Police say they have arrested the woman who was investigated for neglecting 12 dogs in Herkimer County.
Herkimer (WSYR-TV) - State Police say they have arrested the woman who was investigated for neglecting 12 dogs in Herkimer County.

65-year-old Barbara Smith was arrested after Troopers investigated a tip they received back in October that she had numerous malnourished dogs in her front yard.

At the time, the Herkimer County Humane Society said the 12 dogs rescued may be the worst case of animal abuse they’ve ever seen.

Humane society personnel and New York State Police were called to a home located between Herkimer and Middleville back in October, and say they found the dozen dogs malnourished, bald and blind. At least one dog seemed to have broken bones that were never treated.

Utica Attorney Mark Wolber, who was said to be representing Smith, stated back in October, "She has always cared for dogs, she's taken in strays, she loves these dogs."

Smith was charged with:
  • 12 counts of Failure to Provide Sustenance, class A misdemeanor
  • 12 counts of not having a licensed dog
  • 12 counts of not having rabies vaccinations
Smith was arraigned in the Herkimer Town Court and released.

She is due back in court on Dec. 10.
