Civil rights lawsuit filed against DA Fitzpatrick, others in Oral 'Nick' Hillary trial

ST. LAWRENCE COUNTY - Oral "Nick" Hillary has filed a lawsuit against Onondaga County DA Bill Fitzpatrick and others claiming his civil rights were violated during the murder investigation of Garrett Phillips.

Hillary claims he was unfairly singled out by the Prosecution, led by Fitzpatrick, St. Lawrence County officials, Village of Potsdam employees, including the police department, as well as New York State Police.

Hillary was acquitted of the murder last fall and is now seeking damages for "wrongful seizure, false arrest, and malicious prosecution.

The lawsuit cites various actions taken by prosecutors and government officials, that Hillary says violated his civil rights.

He claims the officials listed in the suit were deliberately indifferent, reckless, and unlawful.

In one specific complaint, Hillary's lawyers claim Oral was the only individual strip searched and held for ten hours after being taken into custody.
