DA: No hate crime charges for Ithaca man in alleged murder of transgender woman

ITHACA, N.Y. (WSYR-TV) - A man charged with murder and arson in the death of a transgender Ithaca woman was indicted on Thursday, Tompkins County District Attorney Matthew Van Houten said.

According to police, 45-year-old Michael Davis had a personal relationship with 28-year-old Josie Berrios.

Prosecutors believe the fire Davis caused in June led to the death of Berrios.

Van Houten said that there was no evidence that would have supported calling Davis’ offenses as a hate crime.

Davis was indicted on one count each of first-degree arson and first-degree murder.

If found guilty of first-degree murder, Davis could spend life in prison without the possibility of parole.
