Judge Astacio due back in court for allegedly violating probation

ROCHESTER, N.Y. (WROC-TV) - WROC-TV in Rochester has confirmed that Rochester City Court Judge Leticia Astacio will be back in court on Thursday for allegedly violating her probation.

On July 6, Judge Stephen Aronson sentenced Judge Astacio to 60 days in jail, plus three years probation and ankle bracelet monitoring.

The sentencing includes time served. She was first taken into custody on June 5.

According to Ontario County Asst. District Attorney Zach Maurer, who is prosecuting the case, probation officers allege the ankle monitor that was placed on Astacio June 13 detected alcohol in her system on June 14.

Maurer said Astacio claimed to probation officers the device was triggered from a skin cream she had used on her foot.

When the device was tested at a later date by probation using that same cream, Maurer said it didn't appear to be comparable to the actual reading from July 14th.

"It gave a very different sort of reading. It spiked very high, immediately, and didn't appear to be in any way consistent with the prior reading," Maurer said.
Tuesday night, News 8’s Elijah Westbrook met up with Astacio outside her home and asked her to comment on the latest allegation.

During that conversation, the judge made references to being drunk and indicated she was just getting home after receiving a new tattoo.

In a phone call with WROC-TV News 8 Wednesday morning, Judge Astacio clarified that she was joking, “Why don’t you say I’m drunk?” because she feels that’s the perception of her created by all the media coverage of her case. She pointed out there was no violation of her interlock device nor her ankle monitoring bracelet.

She did tell us the remarks as reported did prompt an inquiry from the probation department. At this time there is no indication of any violations Tuesday night.

Astacio is set to appear in front of Canandaigua City Court Judge Stephen Aronson Thursday morning at the Hall of Justice in Rochester.
