New York AG’s office, Sears settle over deceptive refund policy lawsuit

Sears has agreed to pay $150,000 in fines as part of a settlement with the New York Attorney General’s Office over what it described as deceptive refund policies.
Syracuse (WSYR-TV) – Sears has agreed to pay $150,000 in fines as part of a settlement with the New York Attorney General’s Office over what it described as deceptive refund policies.

In Sears’ “Come Back Cash” program, customers who purchased merchandise above a certain amount of money were given gift cards.

However, according to Attorney General’s Office, if the customer returned an item, Sears reduced the refund by a pro-rated amount of the value of the reward card even if the unreturned merchandise remained above the qualifying threshold.

Attorney General Eric Schneiderman estimates that Sears reduced refunds due to customers by a total of $82,825.62.

They say the practice has already been changed.
