Utica man arrested on multiple weapons charges including SAFE Act violation

Utica (WSYR-TV) – A Utica man is facing multiple weapons charges – including a violation of New York’s new SAFE Act gun laws – after police say he fired a gun at Proctor Park in the city on Tuesday morning.

According to police, they discovered Derek Miller, 24, of Lansing Street in Utica, at Proctor Park while they were investigating a shots-fired complaint when they heard gunshots.

Police say when they moved toward the area, Miller emerged from the woods with his hands in the air.

They discovered that Miller had been firing a Smith & Wesson M&P .223 rifle, claiming he was using it for target practice.

Police charged him with criminal possession of a weapon, a felony; reckless endangerment, a misdemeanor; and discharging a weapon in city limits, a violation.
