Lawyers for convicted murderer Robert Neulander made their argument to have his 2015 conviction overturned on Wednesday.
A judges panel in the Fourth Judicial Department of the New York State Supreme Court Appellate Division in Rochester heard the case.
The well known former Syracuse-area doctor was found guilty of killing his wife Leslie in 2012 and then trying to cover it up.
Neulander is asking for the conviction to be thrown out based on four key points: misconduct by the juror who was texting about the case during the trial with family and friends, insufficiency of the evidence, prosecutorial misconduct by the DA during closing arguments, and ineffective assistance of counsel from his trial lawyer Ed Menkin.
The court could issue a ruling as soon as Nov. 9.
