DEERFIELD, N.Y. (WSYR-TV) — There are some new details in that botched burglary in Oneida County that left two suspects dead.
The Oneida County District Attorney has weighed in, along with the defense attorney for Ronald Stolarczyk.
The homeowner ended up interrupting a burglary at his home along Walker Road in the Town of Deerfield. He’s accused of shooting Patricia Anne Talerico, 57, and Nicholas Talerico, 27.
At this point, Stolarczyk is only facing a weapons charge, though nothing is off the table officially.
“It’s a homicide. There’s no question that it’s a homicide. The question goes down to ultimately a decision being made myself if it’s justified and that there would be no prosecution for the homicides,” said Oneida County District Attorney Scott McNamara.
“He was scared that he was going to die. He said ‘I was afraid I was going to die right then and there.’ He said ‘I did what I had to do to survive’ and I think most people understand the survival instinct. When you’re put in that position, you don’t have a whole lot of time to think about it, said Mark Wolber, attorney for Stolarczyk.
Stolarczyk appeared in Utica City Court on Wednesday morning and will appear in Deerfield Town Court on Monday.
The investigation is ongoing.
